If you do not agree to these Terms, please do not use our services. We reserve the right to update these Terms at any time, with changes effective immediately upon posting. Continued use of our services after any modification constitutes your acceptance of the updated Terms.
2. Services Description
Apex Pesa provides the following financial technology services:
Crypto Exchange: Conversion of USDT (Tether) to Tanzanian Shilling (TZS) and US Dollar (USD), and vice versa, at market-based rates.
Mobile Money Services: Cash In, Cash Out, and Money Transfer services across Tanzanian mobile networks including M-Pesa, Tigo Pesa, Airtel Money, and Halo Pesa.
Trading Mentorship: Educational programs covering cryptocurrency and forex trading strategies, analysis, and risk management.
All services are subject to availability, regulatory compliance, and prevailing market conditions. Apex Pesa reserves the right to modify, suspend, or discontinue any service at any time.
3. Eligibility
To use Apex Pesa's services, you must:
Be at least 18 years of age
Be a resident or citizen with legal standing in Tanzania or any jurisdiction where the services are legally permitted
Not be prohibited from receiving our services under applicable laws
Provide accurate and complete information during onboarding and KYC verification
Agree to receive communications via WhatsApp and email as part of service delivery

Cryptocurrency and forex trading involves a high degree of risk and may not be suitable for all investors. The following risks are associated with our services:
Market Volatility: Cryptocurrency prices can be highly volatile. The value of your investment can go down as well as up rapidly and unpredictably.
Loss of Capital: You could lose all of the money you invest or more. Do not invest money you cannot afford to lose.
Past Performance: Past performance of any trading strategy, signal, or mentorship student result is not indicative of future results.
No Guaranteed Returns: Apex Pesa makes no representation or warranty about returns, profits, or investment outcomes from our trading education programs.
Exchange Rate Risk: Exchange rates fluctuate continuously. The rate quoted is indicative only; the final rate is the rate at the time of transaction execution.
Regulatory Risk: The regulatory environment for cryptocurrencies is evolving. Changes in laws may affect the availability or terms of our services.
Technical Risks: Blockchain transactions are irreversible. Sending to an incorrect wallet address results in permanent loss of funds.
Third-Party Risks: Mobile money networks are operated by third parties. Service disruptions or failures on those networks are beyond our control.
Advisory Notice: Before using our services, we strongly recommend that you: (a) consider your financial situation and risk tolerance; (b) seek independent professional financial advice if necessary; (c) only use funds you can afford to lose for trading or investment purposes.

5. Transaction Terms
All transactions made through Apex Pesa are subject to the following:
Transaction rates are confirmed at the time of transaction initiation via WhatsApp. Once confirmed and the transaction has begun, rates cannot be changed.
All crypto transactions are irreversible once sent. Verify all wallet addresses carefully before sending any cryptocurrency.
Processing times are estimates and not guarantees. Delays may occur due to network congestion, regulatory requirements, or technical issues.
Apex Pesa reserves the right to delay, hold, or refuse any transaction that appears suspicious or potentially violates anti-money laundering regulations.
Minimum and maximum transaction limits apply as outlined on our Services page.
Failed or returned transactions will be processed within 24 working hours.
6. Fees & Charges
Our fee structure is transparent and communicated upfront:
USDT → TZS/USD Exchange: No direct fee. Revenue is earned from the exchange rate spread.
Mobile Money Cash Out: 1% of transaction amount (minimum TZS 500).
Cross-Network Cash In: 0.5% of transaction amount.
Money Transfer: TZS 50 flat fee per transaction.
Trading Mentorship: Program fees vary by level; communicated during enrollment consultation.
Blockchain network fees (gas fees) for cryptocurrency transactions are separate and borne by the sender. We do not collect these fees.
All fees are subject to change with reasonable notice. Current fees are always obtainable via our WhatsApp channel.
7. Prohibited Activities
Users are strictly prohibited from using Apex Pesa's services for:
Money laundering, terrorist financing, or any other illegal financial activities
Fraud, deception, or misrepresentation
Circumventing sanctions or regulatory restrictions
Using fictitious or false identification for KYC purposes
Reselling or brokering our services without express written permission
Any activity that violates the laws of Tanzania or any applicable jurisdiction
Violation of these terms will result in immediate suspension of services and may be reported to relevant authorities.
8. KYC & Anti-Money Laundering Compliance
Apex Pesa complies with applicable Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations. For transactions above certain thresholds, we may require:
Government-issued photo identification (National ID or Passport)
Proof of address
Source of funds documentation
Selfie photo for identity verification
Failure to provide required KYC documents may result in transaction delays or refusals. All KYC information is stored securely and used only for compliance purposes.
9. Privacy Policy
Apex Pesa takes your privacy seriously. This section outlines how we collect, use, and protect your information.

10. Limitation of Liability
To the maximum extent permitted by applicable law:
Apex Pesa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claim related to our services shall not exceed the amount of fees paid by you to Apex Pesa in the 30 days preceding the claim.
We are not liable for losses arising from: market price fluctuations, transaction delays due to network congestion, acts of God, regulatory changes, or actions of third-party service providers.
Apex Pesa is not responsible for any loss arising from the sending of cryptocurrency to an incorrect or malicious wallet address.
11. Intellectual Property
All content on the Apex Pesa website and platforms, including text, graphics, logos, icons, images, and software, is the property of Apex Pesa and protected by Tanzanian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
12. Changes to Terms
Apex Pesa reserves the right to modify these Terms at any time. Changes will be communicated via our website and WhatsApp channel. Continued use of our services after any modification constitutes your acceptance of the new Terms. We recommend reviewing these Terms periodically.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Tanzania. We encourage amicable resolution of disputes through direct communication before formal legal proceedings.
